Cloud Services Terms
The extra terms for domains, DNS, servers, backups and other cloud services you order in Developers › Cloud: what we provide, what you are responsible for, and how ordering, renewal, suspension and ending work.
1. These terms and the rest of the agreement
These Cloud Services Terms add to the Terms of Service and the Business and Channel Terms when a business orders a cloud service through its channel. If they conflict, these terms win for cloud services. The provider is Svayam Incarnation Limited (company number 15228262).
We provide cloud services under our own name. We build them on infrastructure from carefully chosen partners (for example domain registries and registrars, data-centre operators and network providers), who are listed in Sub-processors where they process personal data.
2. Who can order
- A business with a verified owner and a billing account in good standing. We may ask for more checks, a deposit or payment in advance before large or unusual orders.
- The person ordering confirms they may bind the business and makes the Customer Declaration.
- You must be at least 18 and not subject to sanctions.
3. Domains
- You register a domain for a period of one to ten years. You are its registrant (legal holder) and must give true, complete and current details, and keep them up to date. A domain registered with false details can be suspended or cancelled by the registry.
- Every domain is also subject to the rules of its registry and of ICANN or the national registry (for example Nominet for .uk). The registrar of record is shown in the domain’s public WHOIS or RDAP record; its registration agreement applies too.
- Where privacy is turned on we hide your personal details from public WHOIS where the registry allows. Some endings (for example .us) do not allow privacy.
- Renewal: with auto-renew on, we renew before expiry and charge it on your invoice. If a renewal fails or auto-renew is off, the domain expires; most endings then have a grace period in which it can still be renewed, after which it may be released to the public. We remind you before expiry by e-mail.
- Disputes over a name are decided under the registry’s dispute policy (for example the UDRP or Nominet’s Dispute Resolution Service). We follow those decisions and court orders.
- Transfers away are allowed except within 60 days of registration or a previous transfer, or while a dispute or unpaid invoice is open, as registry rules permit.
4. Servers, storage and backups
- A server is a virtual machine of the size you choose, in the region you choose, with the operating system image you choose. You get full control of it (root access with your SSH key). We do not have your private key and do not sign in to your server.
- You are responsible for everything on your server: its software, updates, security, firewall rules, the content it serves and the data it holds, and for keeping your own backups. Snapshots are a convenience, not a guarantee: keep copies of anything you cannot lose somewhere else.
- Snapshots may be limited in number and are deleted automatically after the period shown. Restoring a snapshot replaces the server’s disk; anything written after the snapshot is lost.
- Cancelling a server stops its daily charge from the next day. The server and its disk are deleted when the provider’s term ends and cannot be recovered after that.
- Resources can be moved to a different physical host, or briefly restarted, for maintenance; we give notice of planned work where we can.
5. Acceptable use of cloud services
The Acceptable Use Policy applies, and in particular you must not use cloud services for: sending spam or bulk unsolicited messages; mining cryptocurrency; attacking, scanning or overloading other systems; running open proxies, open mail relays or anonymising services for others without our written agreement; hosting malware, phishing or stolen data; infringing copyright or trademarks; or content that is illegal where it is hosted or viewed.
We act on abuse reports, including those our infrastructure providers pass on to us, and we don’t look at the contents of your server. New servers refuse outgoing connections on port 25: send mail through a mail provider on port 465 or 587, or ask support to lift the block for a mail server you run. A new business can order up to 3 servers a day. If we receive a credible abuse report we tell you and may ask you to act within a set time. For serious or urgent harm (for example an active attack or illegal content) we may restrict the resource at once and tell you why.
6. Suspension and ending
- If an invoice is unpaid 5 days after its reminder, new orders stop and cloud resources may be stopped (not deleted). We tell you before deleting anything; resources stopped for non-payment are kept for at least 30 days.
- For a breach of these terms or the law, we follow the Enforcement policy: notice, a chance to fix it and to appeal, except where the harm is serious or the law requires us to act at once.
- If we stop offering a cloud service, we give at least 90 days’ notice (except where a partner or the law forces a shorter time) and help you move your data and domains.
7. Service levels and liability
Our Service Level Commitments set out availability targets and the service credits you can claim. Service credits are your remedy for downtime. Otherwise, the limits of liability in the Terms of Service and the Business and Channel Terms apply. Nothing limits liability that the law does not allow to be limited.
8. Data
For personal data on your servers and in your domains’ records, you are the controller and we act as your processor under the Data Processing Addendum. You choose where your servers run; data on a server stays in that region unless you move it.
